What to include in a DMCA notice
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- A description of the copyrighted work you claim is infringed.
- A description of the infringing material and where it is located on C-Lebrity.com (provide URLs or precise locations).
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information provided in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright.
- Your contact information, including your address, telephone number, and email address, so we can contact you if needed.
Our response to valid notices.
- We will typically remove or disable access to the allegedly infringing material and notify the user who uploaded it (if applicable) that we have done so.
- We may implement a temporary or permanent suspension or termination of repeat infringers in accordance with our policies and applicable law.
- We will maintain a log of takedown requests and corresponding actions as required by law.
Counter-notice process (for mistaken removals)
- If you believe your content was removed or disabled in error, you may submit a counter-notice to admin@c-lebrity.com.
- A valid counter-notice should include:
- Your physical or electronic signature.
- Identification of the content that was removed or disabled and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification.
- Your contact information, including your address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal court for the district in which you reside, or if you are outside the United States, a statement that you consent to the jurisdiction of the Federal Court for the district in which C-Lebrity.com is located, and that you will accept service of process from the person who provided the original notice or an agent.
- We will provide the claimant who filed the original notice with a copy of the counter-notice and a reasonable opportunity to pursue legal action or to request a court order to keep the content removed.
- If no timely legal action is filed, we may replace the content after the 10- to 14-business-day period, or as required by law, after providing notice to the original claimant.
Repeat infringer policy
- We may terminate or suspend the accounts of repeat infringers in appropriate circumstances in accordance with applicable law and our policies.
Content use and user-generated content
- If you post content to C-Lebrity.com, you grant us a license to display that content on our site as part of our services. If you believe your work is hosted by a user in violation of copyright, you may still submit a DMCA notice as described above.
Privacy considerations
- We handle DMCA notices and counter-notices in accordance with applicable privacy and data protection laws. We may log and share information with relevant parties as needed to process notices and protect rights, consistent with our privacy policy.
